GoDivot Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your use of the GoDivot iPhone and Apple Watch application ("Service") provided by Puddle Labs ("we," "us," or "our"). By downloading, accessing, or using the Service, you agree to these Terms.

2. The Service

GoDivot provides golf tracking and analysis features, including:

  • Apple Watch-based round start and end controls
  • Automatic golf swing detection using Apple Watch motion sensors
  • Shot location, round path, distance, elevation, and map views
  • Heart rate and other HealthKit-based round statistics when you grant permission
  • Round, shot, club, and performance trend review on iPhone

3. No Account Requirement

GoDivot currently does not require an account or login. Round, shot, and preference data is primarily stored locally on your devices. You are responsible for managing your device, backups, and local app data.

4. Permissions and Device Requirements

Certain features require compatible Apple devices and permissions such as Location, Motion & Fitness, HealthKit, Notifications, Bluetooth, and Apple Watch Connectivity. If you deny or later revoke permissions, some features may not work or may be limited.

5. Accuracy and Safety

  • GPS, elevation, heart rate, swing detection, distance, and map information may be inaccurate, delayed, incomplete, or unavailable.
  • GoDivot is intended for personal golf tracking and review. It is not a medical, safety, emergency, professional coaching, or official scoring tool.
  • You are responsible for your play decisions, course etiquette, local rules, device handling, and personal safety.
  • Do not use the Service in a way that distracts you or others during play.

6. Free and Paid Features

GoDivot may offer free features and paid features through auto-renewing subscriptions or other in-app purchases. Paid features are processed through Apple In-App Purchase and are subject to Apple's payment, subscription, cancellation, refund, and family sharing policies.

Subscription terms, prices, trial availability, renewal periods, and included features are shown in the app and in Apple's purchase sheet before purchase. You can manage or cancel subscriptions in your Apple account settings.

7. Acceptable Use

You agree not to:

  • Reverse engineer, tamper with, abuse, or disrupt the Service except as permitted by law
  • Attempt to bypass subscription, entitlement, usage limit, or security mechanisms
  • Use the Service to violate laws, course rules, or the rights of others
  • Misuse another person's data, device, Apple ID, or subscription
  • Use automated tools or scripts to interfere with the Service or its third-party providers

8. Third-Party Services

The Service may rely on Apple services, Google Maps, Firebase Analytics, Firebase Remote Config, and other platform services. These third-party services may be governed by their own terms and privacy policies. We are not responsible for third-party outages, policy changes, or data handling outside our control.

9. Changes to the Service or Terms

We may add, remove, modify, suspend, or discontinue features at any time. We may update these Terms from time to time. Material changes will be posted on this page or announced in the app where appropriate. Continued use of the Service after changes become effective means you accept the updated Terms.

10. Intellectual Property

The Service, including its software, design, trademarks, logos, and content, is owned by Puddle Labs or its licensors and is protected by applicable intellectual property laws. These Terms do not transfer any ownership rights to you.

11. Disclaimers and Limitation of Liability

The Service is provided "as is" and "as available" to the maximum extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, accurate, or available at all times.

To the maximum extent permitted by law, Puddle Labs will not be liable for indirect, incidental, consequential, special, punitive, or lost data damages arising from your use of the Service.

12. Governing Law

These Terms are governed by the laws of the Republic of Korea, without regard to conflict of law rules. Disputes shall be resolved in the competent courts of the Republic of Korea, unless applicable consumer protection laws require otherwise.
